You should carefully read the following terms and conditions before registering for a freeware user account. Your use of this software indicates your acceptance of this license agreement. This is a legal agreement (this "Agreement") between you (either an individual or an entity) and Mandomartis Company ("Mandomartis"). This Agreement is part of a web site containing a software (hereby called "EFFECTMAKER") for creating web effects based on Macromedia Flash (hereby called "THE EFFECTS").

1. GRANT OF LICENSE. Mandomartis hereby grants you a personal, non-exclusive, non-transferable license to use one account of this Software during a limited time. This time is extended each time you log into your account. This grant of license gives the right to use material created with THE EFFECTMAKER on an unlimited number of web sites or on your computer. You may not decompile, disassemble, or reverse engineer THE EFFECTMAKER and THE EFFECTS, and you may not create derivative works of THE EFFECTMAKER and THE EFFECTS, including (without limitation) for the purpose of obtaining unauthorized access to THE EFFECTMAKER. You agree not to access THE EFFECTMAKER by any means other than through the interface that is provided by Mandomartis for use in accessing THE EFFECTMAKER. You may modify, translate or adapt the HTML code of THE EFFECTS. You are not granted any right, title, or interest in THE EFFECTMAKER or THE EFFECTS except the right to use it in accordance with this Agreement.

2. REDISTRIBUTION. Redistribution and reselling of THE EFFECTS is allowed together with it's necessary images and sound files.

3. MODIFICATIONS TO THE EFFECTMAKER Mandomartis reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, THE EFFECTMAKER or THE EFFECTS (or any part thereof) with or without notice. You agree that Mandomartis shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

4. WARRANTY.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

(a) YOUR USE OF THE EFFECTMAKER AND OF THE EFFECTS IS AT YOUR SOLE RISK. THE EFFECTMAKER IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. MANDOMARTIS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

(b) MANDOMARTIS MAKES NO WARRANTY THAT (i) THE EFFECTMAKER WILL MEET YOUR REQUIREMENTS, (ii) THE EFFECTMAKER WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE EFFECTMAKER WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE EFFECTMAKER WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

(c) ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE EFFECTMAKER IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

(d) NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM MANDOMARTIS OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THIS USER LICENCE AGREEMENT.

5. COPYRIGHT. THE EFFECTMAKER and THE EFFECTS are owned by Mandomartis and are protected by Swedish copyright law and international treaty provisions.

6. TERMINATION. The license will terminate immediately without notice from Mandomartis if you fail to comply with any provision of this license. You agree that Mandomartis, in its sole discretion, may terminate your password, account, use of THE EFFECTMAKER or use of any other EFFECTMAKER service, and remove and discard any Content within your account, for any reason. You agree that any termination of your access to THE EFFECTMAKER under any provision of this license agreement may be effected without prior notice, and acknowledge and agree that Mandomartis may immediately deactivate or delete your EFFECTMAKER account and all related information and files in your ACCOUNT and/or bar any further access to such files or THE EFFECTMAKER. Further, you agree that Mandomartis shall not be liable to you or any third-party for any termination of your access to the Service.

7. LIMITATION OF LIABILITY. IN NO EVENT WILL MANDOMARTIS OR ITS SUPPLIERS BE LIABLE FOR ANY LOST REVENUE, PROFIT, OR FOR DIRECT, SPECIAL, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES HOW EVER CAUSED AND REGARDLESS OF THEORY OF LIABILITY, ARISING OUT OF THE USE OF OR INABILITY TO USE THE EFFECTMAKER AND THE EFFECTS, EVEN IF MANDOMARTIS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. GOVERNING LAW. This agreement is made under, shall be governed by and construed in accordance with, the laws of Sweden.
